LIMITED WARRANTY

This Limited Warranty is given by Creative Energies, Inc for the below specified periods from date of purchase/manufacture. Creative Energies, Inc. will replace or repair, at its discretion, parts that are defective in material or workmanship.
*Buyer is responsible for all shipping costs.

As of 2018 - This Limited Warranty supersedes all previous issued warranties.

This warranty does not cover the following: defects attributable to or resulting from normal wear and tear, damage from misuse or neglect, wind/storm damage, alterations or negligence, units which have been modified or incorporated into other products.

For the top and the side curtains, Creative Energies will repair or replace the top or side curtains without charge to the customer (*Except Shipping) for a period of one hundred eighty (180) days from the date of purchase provided damage is not due to any instance(s) listed above in Paragraph 2 of this Limited Warranty. All canopy tops are guaranteed for Ten (10) years from manufacture date not to leak AT THE SEAMS or pocket water. Creative Energies, Inc. will repair or replace the top without charge (*except shipping) to the customer provided the leaking or pocketing is not due to any instance(s) listed above in Paragraph 2 of this Limited Warranty. Otherwise; repairs and/or replacement will be done at a pro-rated cost basis.

For frame components and all other components (“miscellaneous components”) other than the top and the side curtains, Creative Energies, Inc. will repair or replace the frame components and miscellaneous components without charge to the customer (*Except Shipping) for a period of one hundred eighty (180) days from the date of purchase provided the damage is not due to any instance(s) listed above in Paragraph 2 of this Limited Warranty. Otherwise; repairs and/or replacement will be done at a pro-rated cost basis. *Buyer is responsible for all shipping costs.

In order to receive warranty service, call Creative Energies, Inc. at 1-352-351-8889 to obtain an authorized number. All packages received without an authorization number will be refused. Properly pack your defective parts. We recommend using the original carton and packing materials. Include in the package a copy of the sales receipt or other evidence of the date of original purchase. Also include your name and address and description of the defect. Ship the defective parts via United Parcel Service, addressed to Creative Energies, Inc., 1805 NE 19th Avenue, Ocala, FL 34470. Make sure that you include your authorization number on the address label of the package and insure the package for full value. *Buyer is responsible for all shipping costs.

IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED, Creative Energies, Inc. SHALL NOT BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER DIRECT OR INDIRECT, AND WHETHER ARISING IN CONTACT OR IN TORT.
This warranty gives you specific legal rights and you may also have other rights, which vary from state to state. Some states do not allow limitations on Implied Warranties, so the limitations stated above may not apply to you. Some states do not allow the exclusion or limitation of Incidental or Consequential damages, so the above limitation may not apply to you.

TERMS AND CONDITIONS OF SALE
Used merchandise is non-refundable.
No merchandise shall be returned without prior authorization and an authorization number. 3 Day Return Policy without a Restocking Fee. 4-10 day returns with a 15% restocking fee. NO returns accepted after 10 days. All returns must be unused, in original packaging and issued an RGA#. No returns accepted without an RGA#. To be issued an RGA# call 352-351-8889. The return expense is incurred by the customer unless pre-approved by customer service. All returns must be shipped and insured NOT mailed. Defects/Shipping Damages must be reported within 3 Days from receipt. *Buyer is responsible for all shipping costs.

Buyer shall indemnify and hold Seller harmless from and against any claim which may be made by any person arising out of the purchase or use of any product or use of any product into which the merchandise covered by this order is ultimately incorporated. Buyer shall name Seller as an additional insured under any insurance policy relating to liability which Buyer may now have or may hereafter obtain with respect to products using the merchandise covered by this order.
Buyer agrees by acceptance of this product, that venue for all legal actions arising by virtue of the purchase shall be in Marion County, Florida, USA and that the laws of the State of Florida shall govern all disputes. Buyer further agrees that, by acceptance of this product, Seller’s liability shall be limited to the purchase of the product. Seller may replace defective merchandise with new or blemished merchandise or may repair defective merchandise at its option. *Buyer is responsible for all shipping costs.
